This website is property of Akorn AG, Switzerland. Your privacy on the Internet is important to us. At Akorn, we want to make your experience at our website the best possible and safe. We gather set types of information about our website visitors and we feel you should understand our policy and the terms and conditions surrounding the collection and use of that information. This privacy statement discloses the information we gather and how we store and use it.

 

Definitions

Associate: An individual who is employed by Akorn Incorporated.

Audience: Website visitors who are current customers, prospective customers, and anonymous website visitors.

Communication: The act of reaching out to a website visitor by means of telecommunication, direct mail, or email.

Tracking: Using a method to collect data as a website visitor browses a website.

Trigger: A predetermined action created from a website visitor completing a particular action on the website (i.e. clicking a submit button, finalizing an order, submitting a form, abandoning a shopping cart). The predetermined action can be in the form of a confirmation, welcome, product announcement, or thank you communication delivered through direct or electronic mail.

 

Information Akorn Gathers and Tracks

Akorn gathers two types of information about website visitors:

  • Information website visitors provide by optional, voluntary submissions. These are voluntary submissions to receive our electronic newsletters, to receive electronic product updates, forwarding of emails, and from participation in forms, polls and surveys.
  • Information Akorn gathers through tracking information derived by gathering click through information of page views throughout our website and microsites. This information allows us to provide more relevant content to readers‘ interests and needs, to help our advertisers and sponsors better understand the demographics of our audience, and to continuously improve user web experience. Under no circumstances does Akorn divulge any information about an individual user to another company or individual.

We offer the following free downloads, which require some type of voluntary submission of personal information by website visitors:

  1. Electronic newsletter policy

Akorn offers a free electronic newsletter to website visitors. Akorn gathers the email addresses of website visitors who voluntarily subscribe. Website visitors may remove themselves from this mailing list by following the link provided in every newsletter that points website visitors to the email preference center. Website visitors also have the option to subscribe to newsletters at the time of registration with Akorn Direct.

 

  1. Electronic Product Updates, Alerts, Online Promotion

Akorn offers a free electronic updates, alerts, and online promotions to website visitors. Akorn gathers the email addresses of website visitors who voluntarily subscribe. Website visitors may remove themselves from this mailing list by following the link provided in every email linking website visitors to the email preference center. Website visitors also have the option to subscribe to other email programs at the time of registration with Akorn Direct.

 

  1. „Forward“ policy

Website visitors can choose to electronically forward a link, page, or documents to someone else by clicking „forward“. The visitor must provide both their and the recipients email address. The information provided is used to communicate failed forwarded emails and to make the website visitor aware that the message came from Akorn or an associate of Akorn.

 

  1. Polling

Akorn may offer interactive polls to website visitors so they can easily share their opinions with other website visitors and see what our audience thinks about important issues. Opinions or other responses to polls are collected and are not identifiable to any particular website visitor. Akorn may use a system to „tag“ website visitors after they have voted, so they can vote only once on a particular question. This tag is not correlated with information about individual website visitors and is delivered in the form of a cookie.

 

  1. Surveys

Akorn may occasionally send user surveys to improve and optimize content delivered to our website visitors. We sometimes share the collected demographic information in these surveys with our sponsors, advertisers and partners. We never share any of this information about specific individuals with any another company or individual.

 

Usage tracking

Akorn tracks user traffic patterns throughout the Akorn website and all of our microsites. We do not correlate this information with data about individual website visitors. Akorn does analyze overall usage statistics according to a user’s domain name, browser type, and MIME type by reading this information from the browser string (information contained in every website visitor’s browser).

 

Akorn sometimes tracks and stores the search terms website visitors enter in our Search function, but this tracking is never associated with individual website visitors. We use tracking information to determine which areas of our sites website visitors like and don’t like based on traffic to those areas. We do not track what individual website visitors read, but rather how well each page performs overall. This helps us continuously make improvements for you.

 

Cookies

Akorn may place a text file called a „cookie“ in the browser files of your computer. The cookie itself does not contain personal information although it will enable us to relate your use of this site to information that you have specifically and knowingly provided. Each cookie has a determined expiration date and will automatically remove itself from the browser files. The only personal information a cookie contains is the information you provide voluntarily. A cookie cannot read data off your hard disk or read cookie files created by other websites. Akorn uses cookies to track website users (as described above) and as a functionality to improve the shopping experience at Akorn Direct. Our marketing automation system delivers a one-time cookie to better track campaign impressions and click rates.

 

You can refuse cookies by turning them off in your browser. If you have set your browser to warn you before accepting cookies, you will receive the warning message with each cookie. You do not need to have cookies turned on to use this website. However, you do need cookies to place orders.

 

Use of Information

Akorn uses any information voluntarily given by our website visitors to enhance their experience when visiting Akorns website and microsites, whether to provide interactive or personalized elements on the website and microsites, or to better prepare future content based on the interests of our website visitors.

 

We use information that website visitors voluntarily provide in order to send out electronic newsletters, product updates and confirmation triggered from an action made on the website. Akorn also gives website visitors the opportunity to participate in polls, forms, surveys, message boards, and forums. We send out newsletters and product updates to subscribers on a regular schedule (depending on the program), and occasionally send out special editions when we think subscribers might be particularly interested in something we are doing. Akorn never shares mailing lists with other companies and individuals, including advertisers, sponsors or partners.

We do not track what individual website visitors read, but rather how well each page performs overall. This helps us continue to build a better service for you. We track search terms entered in Search function as one of many measures of what interests our website visitors. But we don’t track which terms a particular user enters.

 

Akorn creates reports on user demographics and traffic patterns for advertisers, sponsors and partners. This allows our advertisers to advertise more effectively, and allows our website visitors to receive advertisements that are pertinent to their needs. Because we do not track the usage patterns of individual website visitors, an advertiser or sponsor will never know that a specific user clicked their ad. We will not disclose any information about any individual user except to comply with applicable law or valid legal process or to protect the personal safety of our website visitors or the public.

 

Sharing of Information

Akorn uses the above-described information to tailor our content to suit your needs and help our advertisers better understand our audience’s demographics. We will not share information about individual website visitors with any another company or individual, except to comply with applicable law or valid legal process or to protect the personal safety of our website visitors or the public.

 

Promotions and Customer Engagement

Akorn does not disclose your information with outside companies for their promotional use, does not sell or rent mailing lists to other companies or individuals, and protects the privacy of website visitors viewing products or services at the Akorn website.

 

Akorn will contact its valued customers and audience with important news about product updates, new products and services, and other promotional offers. You will automatically receive our mailings with promotions related to previous purchases you have made or from making contact with us by phone, visiting our booth at a tradeshow, contact with one of our sales representatives, submittal of an online form, or other related forms of contact. You may update your email preferences at anytime to customize the way Akorn delivers information to you.

 

Email Preferences and Opting Out

You may opt-out or our programs by directly unsubscribing or by changing your email preferences at any time. Your email preferences include subscribing to email programs, unsubscribing to specific programs, globally unsubscribing to all programs, and snoozing email subscriptions. By updating your preferences you are able to remain subscribed to continue receiving special internet promotions, product updates, offers, and press releases from time-to-time.

 

If you choose to globally unsubscribe to Akorn’s email program(s), we will no longer contact you with newsletters, product updates, new products and services or press releases according to your preferences. Once unsubscribed, the process of removing the email address from our lists takes no more than 10 days. We may continue contacting you about critical product notices that could affect the ability to use our products or services, if you contact us requesting information, and with information regarding a recent order.

 

Children

Consistent with the Federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent.

 

Security

Akorn operates secure data networks protected by industry standard firewall and password protection systems. Our security and privacy policies are periodically reviewed and enhanced as necessary and only authorized individuals have access to the information provided by our customers.

As part of our commitment to protecting your privacy, Akorn has elected to adhere to the Safe Harbor Principles of the United States Department of Commerce with respect to personal data collected by Akorn directly from residents of the European Union. By certifying this election with the Department of Commerce, Akorn has declared that it intends to provide privacy protection with respect to such personal data in accordance with the Safe Harbor Principles.
